After hearing the testimony of both players involved and their representatives, as well as watching the video evidence of the aciton in question provided by the ASA, The Disciplinary Commissioner concludes that the referees' decision to consider the incident as agressive play, was too harsh, also given the fact that this was the first incident half way through the 1st session and not following a series of events. In view of the above, the Disciplinary Commissioner decides that no further sanction should be taken towards both players.

Decision 1:
Matthew Zammit (San Giljan) found guilty in terms of DC-B1-12-A (P) and fined €100 and suspended to 1 Enemed Cup match. Since this incident occurred after the Final of this competition, this suspension will be carried forward to next year’s Enemed Cup.

Both clubs and referees confirmed that the player was a San Giljan player and not a Sliema player. Daniel Tully (San Giljan) is guilty in terms of DC-B1-9 (M) and suspended for 2 U17 matches. Since the competition is over this suspension is converted to a fine of €100 as per DC-A3.ii.
B’Buga ASC guilty in terms of DC-B13. Since this offence for water polo is not mentioned in the Disciplinary Code, B’Buga ASC are fined €100 according to DC-A4.vi.

Decision 1:
The Disciplinary Commissioner acting on the report submitted, and in particular the phrase that Lawrence Borg approached Karl Galea in an agressive manner, decides that this was not the case. On the other hand, since B'Buga did not feel the need to file a report about the incidents, no other action can be taken against any other person who was not reported of any wrongdoing.
The deposit paid by B'Buga is to be returned to the club.

After hearing the submissions of both parties and all the witnesses, Mr Sandro Pecorella, the Disciplinary Commissioner concludes as follows:-
Mr Rainer Scerri, after having been escorted from the pool deck by two ASA Officials (Carlo Mifsud and Karl Galea) did not leave the precincts of the pool as he was obliged to do. The fact that Mr Matthew Bonello exited from the stands and walked towards the Reception Area without feeling threatened in any way by the opposing club’s committee members, proves that at no point in time was Mr Rainer Scerri in any personal danger.
From the video evidence produced Mr Rainer Scerri’s unacceptable actions and verbal threats towards Mr Carlo Mifsud outside the Reception/Entrance Door were very clear, so much so that even his Club President, Mr Matthew Bonello, had to restrain him from aggravating his own and his club’s position.
In view of the above, Mr Rainer Scerri is found guilty in terms of DC-B1-13 (O) and fined €240 and suspended for 3 Senior matches. Mr Scerri is also found guilty in terms of DC-B1-18-A (R) and fined a further €190 and suspended for an additional 2 Senior matches.
Since Mr Scerri did not leave the precincts of the pool, these sanctions are doubled in terms of DC-A4.xi. Mr Scerri is therefore fined a total of €860 and suspended for 10 Senior matches.
The Disciplinary Commissioner also finds Rainer Scerri to be a repeat offender in terms of DC-A5 and fines him an additional €100.
The contestation deposit shall be forfeited in favour of the ASA.
Rainer Scerri found guilty in terms of DC-B1-16 (Q) and fined €150 and suspended for 1 U13 match. Since Mr Scerri did not leave the precincts of the pool, these sanctions are doubled in terms of DC-A4.xi. Mr Scerri is therefore fined €300 and suspended for 2 U13 matches.
The Disciplinary Commissioner also finds Rainer Scerri to be a repeat offender in terms of DCA5 and fines him an additional €100.
After clarifying the contents of the report, Rainer Scerri (Neptunes Team Official) is found guilty in terms of DC-B3-05 and fined €250 and suspended for 2 Senior matches (Men).
The Disciplinary Commissioner also finds Rainer Scerri to be a repeat offender in terms of DC-A5 and fines him an additional €100.
